These Terms of Service (“Terms”) govern your access to and use of the Kainos Fragrances website, online store, and related services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

Kainos Fragrances (“we”, “us”, “our”) reserves the right to update or modify these Terms at any time. Any changes will be effective immediately upon posting.

1. Use of Our Services

By using our Services, you confirm that:

  • You are at least 18 years of age, or using the Services under the supervision of a legal guardian

  • You will use the Services for lawful purposes only

  • You will not misuse, disrupt, or attempt to gain unauthorised access to our systems

We reserve the right to refuse service to anyone for any reason permitted by law.

2. Products, Inspired-By Fragrances & Trademark Disclaimer

Kainos Fragrances is an independent fragrance brand. We are not affiliated with, endorsed by, or sponsored by any designer brand or trademark mentioned. All trademarks and copyrights remain the property of their respective owners and are referenced strictly for descriptive and comparison purposes.

Our products are inspired-by fragrances. Any references to well-known fragrances or scent profiles are made solely to describe the character of the fragrance.

Our fragrances are not identical to any designer or branded fragrance. Fragrance performance, longevity, and scent perception may vary depending on individual skin chemistry, application, and environmental factors.

3. Orders & Payments

All prices are listed in South African Rand (ZAR) unless otherwise stated.

By placing an order, you agree that:

  • All information provided is accurate and complete

  • You are authorised to use the payment method provided

Payments are processed securely through third-party payment providers. Kainos Fragrances does not store full payment card details.

We reserve the right to cancel or refuse any order due to pricing errors, stock availability, suspected fraud, or breach of these Terms.

4. Shipping & Delivery

Delivery timeframes are estimates only and may vary due to courier delays or circumstances beyond our control.

Once an order has been dispatched, responsibility for delivery lies with the courier. Risk of loss passes to the customer upon delivery.

5. Returns & Refunds

Our Returns & Refunds Policy forms part of these Terms.

Due to the hygienic nature of fragrance products:

  • Opened or used perfumes cannot be returned

  • Returns are accepted only for damaged, defective, or incorrectly supplied items, in accordance with the South African Consumer Protection Act

6. Cooling-Off Period (Consumer Protection Act)

In accordance with South African law, customers may cancel certain online purchases within 7 days, provided that:

  • The product is unused

  • The product is unopened

  • The product is returned in its original, resaleable condition

This right does not apply to unsealed fragrance products due to hygiene considerations.

7. Intellectual Property

All content on this website—including text, images, logos, product descriptions, and branding—is the property of Kainos Fragrances and may not be copied, reproduced, distributed, or used without prior written permission.

8. Limitation of Liability

To the fullest extent permitted by law, Kainos Fragrances shall not be liable for:

  • Any indirect, incidental, or consequential damages

  • Loss or damage arising from misuse of products

  • Allergic reactions or sensitivities

Customers are encouraged to review product information carefully before use.

Our total liability shall not exceed the value of the product purchased.

9. Indemnification

You agree to indemnify and hold harmless Kainos Fragrances from any claims, losses, damages, or expenses arising from your use of the Services or breach of these Terms.

10. Privacy

Your use of our Services is governed by our Privacy Policy, which explains how we collect, use, and protect personal information in accordance with the Protection of Personal Information Act (POPIA).

11. Online Business & Communication Policy

Kainos Fragrances operates strictly as an online business.

All customer enquiries, support requests, and legal communications must be made via the contact channels listed below.

In-person visits, walk-ins, or physical correspondence at our registered or residential address are not permitted or accommodated.

12. Governing Law

These Terms are governed by and interpreted in accordance with the laws of the Republic of South Africa.

Any disputes arising from these Terms shall be subject to the jurisdiction of South African courts.
